Safeguarding Financial Welfare Across Borders - A Case Study

Rushpal, a caring daughter, had lived and worked in the UK for most of her life. When her father, Tajinder, was diagnosed with Parkinson's disease, he decided to move in with Rushpal in Denmark to be closer to family and receive the support he needed. Rushpal gladly welcomed her father, and together they faced the challenges of his illness with unwavering love and care.

As Tajinder's condition progressed, it became evident that managing his finances required additional attention. Rushpal initially explored the option of creating a lasting power of attorney to ensure that she could take care of her father's financial affairs when needed. To her surprise, they discovered that a lasting power of attorney was already in place, granting decision-making authority to a neighbour—an arrangement neither Rushpal nor Tajinder were aware of.

Concerns arose when Rushpal started reviewing her father's accounts and found regular withdrawals from his funds, even though he now resided in Denmark. The situation became complicated as the neighbour holding the lasting power of attorney was in the UK. Rushpal realised the urgent need to address this situation and ensure that her father's financial well-being was protected.

Seeking professional guidance and support, Rushpal turned to Nellie Supports for assistance. She hoped to assess her father's capacity to create a new lasting power of attorney, which would grant her the authority to manage his finances securely. However, Tajinder's Parkinson's disease had advanced, and he was unable to make such decisions on his own.

Realising the importance of securing his financial welfare, we proceeded to complete a COP3 Deputyship application. This report presented a balanced evaluation, taking into account Tajinder's condition and the need for a responsible and compassionate deputy to manage his finances.

With our report in hand, Rushpal and Tajinder approached the Court of Protection, where our assessment was instrumental in the decision-making process. The court appointed Rushpal as Tajinder's deputy for finances, overturning the existing lasting power of attorney. This legal step ensured that Rushpal had the authority to act on her father's behalf, protecting his financial interests and ensuring his well-being, even across international borders.
